Terms of Service

1. Agreement
These terms form an agreement between you and MarkPad. By creating an account or using the service you accept them. If you use MarkPad on behalf of a school, college or training provider, you confirm you are authorised to accept these terms for that organisation.
2. Your account
You are responsible for keeping your sign-in details secure and for all activity under your account. Accounts are for named individuals — do not share credentials with colleagues. Tell us immediately if you believe an account has been compromised.
3. Learner content you upload
Workbooks, memos, rubrics, signatures and any other files you upload remain yours. You grant MarkPad the limited licence needed to store, process, annotate and export that content so we can provide the marking features you ask for. You confirm you have the right to upload learner work and that you handle learner information in line with the privacy law that applies to you.
4. AI-assisted marking
MarkPad proposes ticks, comments, scores and feedback using automated models. These proposals are drafts. You remain the assessor of record: you must review, adjust and approve every page and every judgement before you rely on or issue a marked workbook. MarkPad does not guarantee that automated marking is accurate, complete or suitable for any accreditation requirement.
5. Acceptable use
Do not use MarkPad to upload unlawful content, attempt to break or overload the service, reverse engineer it, resell access without our written agreement, or upload files you have no right to process. We may suspend accounts that put the service or other users at risk.
6. Availability and changes
We work to keep MarkPad available, but the service is provided on an "as is" and "as available" basis. Features may change, and we may add, alter or retire functionality. Where a change materially reduces what you rely on, we will give reasonable notice.
7. Liability
To the extent the law allows, MarkPad is not liable for indirect or consequential loss, lost data that you have not backed up, or marking decisions made in reliance on automated suggestions. Nothing in these terms limits liability that cannot lawfully be limited.
8. Ending your use
You may stop using MarkPad and delete your account at any time. We may end access where these terms are broken. On closure, we delete or anonymise your stored workbooks and exports within a reasonable period, except where we must keep records by law.
